Effective January 1st of 2020, hourly wages for employees in the State of Florida will increase to a minimum wage of $8.56 per hour.
This minimum wage is up 10 cents from the current minimum wage in the Sunshine State of $8.46 per hour. Minimum wages for tipped employees will also increase by the same amount. This amount is currently $5.44 and will increase to $5.54 per hour, in addition to tips.
The Florida minimum wage of $8.56 prevails over that of the Federal minimum wage which is just $7.25 per hour, according to the Florida Department of Economic Opportunity.
How The Florida Minimum Wage Is Calculated?
The Florida minimum wage rate, like many other States, is recalculated yearly on September 30th. The minimum wage rate is based on the Consumer Price Index which is calculated by the Bureau of Labor Statistics in the United States.
Your Rights As An Employee.
An employer found liable for intentionally violating minimum wage requirements is subject to a fine of $1,000 per violation, payable to the state. The Attorney General or other official designated by the Legislature may bring a civil action to enforce the minimum wage.
An employer may not retaliate against an employee for exercising their right to receive the Florida minimum wage. Rights that are protected by the State Constitution include the right to:
- File a complaint about an employer’s alleged noncompliance with lawful minimum wage requirements.
- Inform any person about an employer’s alleged noncompliance with lawful minimum wage requirements.
- Inform any person of his or her potential rights under Section 24, Article X of the State Constitution and to assist him or her in asserting such rights.
